Election Procedures for Directors

 

Part I

GENERAL

 

Section 1.  All regular members of the Alliance shall be entitled to vote.

 

Section 2.  An official list of regular Alliance members shall be created using the employee contributor list provided by the District Payroll Department for the month of October.

 

Section 3.  Each regular member of the Alliance will be allowed to nominate two (2) candidates for each vacancy on the Board which represents the member’s particular employment category (Category A, Category B, or Category C).  For each election, any member may nominate himself or herself, once.

 

Section 4.  Pursuant to the Bylaws and Standing Rules of the Alliance, the seats of approximately half of the members of the Board of Directors shall be elected each year.  Those Directors whose terms are expiring shall be identified at a meeting of the Board by no later than the end of October.

 

 

Part II

NOMINATIONS

 

Section 1.  Lists of members in each of the three employment categories will be prepared and included in nominations packets.  These packets will be provided to each member as soon as is practical in November, and will contain instructions and notifications of deadlines for participating in the nominations process.  Nominations shall be received the third week of November, and elections shall take place no later than the second week in December.

 

Section 2.  From the list of nominees, the most frequently nominated candidates from each category shall be placed on the ballot.  The number of candidates in each category shall be no more than four times the number of vacancies in that category.

 

Section 3.  Each nominee who qualifies to be placed on the ballot shall be contacted to determine his or her willingness to serve on the Board;  only willing candidates’ names shall be placed on the ballot.

 

Section 4.  Any current elected Director whose term on the Board will expire shall be considered to have been nominated for reelection if they inform the Board of their willingness to be a candidate.   Upon the timely receipt of such a Director’s willingness, his/her name shall appear on the ballot for their employment category, unless seeking another term is prohibited by the Bylaws or Standing Rules of the Alliance.

 

 

Part III

ELECTION PROCESS

 

Section 1.  Measures will be taken to assure that no voter can return more than one ballot.

 

Section 2.  Ballots will be sent through the district mail service or hand delivered to each eligible voter.  Each voter packet will contain a ballot, a security envelope, a return envelope, and instructions to the voter.  Each voter packet may also contain other BAESE literature, such as a newsletter or summary of BAESE activities;  if included, such literature shall not promote any candidate.

2.1  The instructions will include a deadline date for receipt of the voted ballot;

2.2  The voter packet will be individually addressed to each voter;

2.3  The ballots for each of the three membership categories shall be different colors.

 

Section 3.  Voters will mark their ballots and return in such a way that the secrecy of their vote will be assured.

 

 

Part IV

COUNTING AND NOTIFICATION

 

Section 1.  Only ballots received by the deadline date for receipt of voted ballots, as included in the instructions packet, shall be counted.

 

Section 2.  A committee of at least three Directors will assemble at an agreed-upon date and time to count the ballots.  No person who is a candidate for election shall handle the voted ballots until after they are counted.

 

Section 3.  In the event of a tie vote for a Director position, the winner shall be determined by coin toss.

 

Section 4.  Candidates will be informed of the outcome of the election as soon as practical after the results are tallied.  Either telephone or email shall be acceptable methods of informing candidates.

 

Section 5.  Posting of election results to the public may be carried out through the newsletters of the various member categories.

 

Section 6.  Voted ballots will be retained by the Secretary for a period of at least one year.

 

 

Part V

CHALLENGE

 

Section 1.  Any candidate in the election will have the right to inspect the voted ballots and challenge the announced outcome of the election.  Such a challenge must be in occur within ten school days after the initial announcement of the results of the election.

 

Section 2  All challenges must be in writing and shall state the grounds for the challenge.

 

Section 3  The Board of Directors, as constituted prior to the election, shall make a determination of the validity of any challenges.  This determination shall be final and binding.

 

 

Part VI

RESERVE CANDIDATES LIST

 

Section 1.  The names of candidates for election to the Board of Directors who are not elected shall be placed on a Reserve List in the order of the number of votes that each received.  In the event of a subsequent vacancy on the Board, the Board may use the Reserve List to produce names for potential successors.
